Managing Discrimination, Harassment and Bullying

Anti discrimination laws and the Fair Work Act 2009 impose numerous restrictions on employment related decisions such as recruitment, promotion, transfer and termination.

Those laws also prohibit certain forms of workplace conduct. A failure to understand and manage these issues can result in liability for employees and employers.

In addition, workplace harassment and bullying can pose serious threats to the health, safety and welfare of people in the workplace, thereby placing the employer in breach of OHS legislation. It is vital that preventative measures are taken to prevent adverse consequences.

Siobhan Flores-Walsh, Partner LLB, BA

Siobhan has worked in employment/workplace relations for 20 years, with top tier law firms, in-house at Shell Oil and as the ABC TV’s Industrial Relations Manager. She has prosecuted breaches of industrial laws and litigated extensively in common law courts, industrial tribunals and OHS jurisdictions.

Siobhan conducts training in flexible work practices, complaints handling, workplace surveillance, OHS and discrimination, bullying and harassment. She is a contributing author of the CCH publication “The Australian Master Human Resources Guide” and has published numerous articles about workplace law including 2009 publications in The Australian, Human Resources Magazine and Lawyers’ Weekly.
